Welcome to TEKZO! The terms “we,” “us,” and “our” refer to TEKZO. TEKZO operates this store and this website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with a customized shopping experience (the “Services”). TEKZO is powered by Shopify, which enables us to provide the Services to you.

The following terms and conditions, together with any policies referenced herein, these “Terms of Service” or “Terms,” describe your rights and responsibilities when using the Services.

Please read these Terms of Service carefully, as they contain important information about your legal rights and, among other things, cover disclaimers and limitations of liability.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or the Privacy Policy, you may not use or access our Services.

We do not guarantee that products or services will fully match your expectations or the display/description in the online store. All product descriptions may be changed without notice. We reserve the right to remove products and to limit quantities to any person, region, or jurisdiction.

When you place an order, you are making an offer to purchase. TEKZO may, at its sole discretion, accept or reject your order for any reason. An order is only accepted once TEKZO has confirmed it and received and processed your payment.

Please review your order carefully before submitting it, as we may not be able to cancel it after the order has been accepted. If we do not accept, modify, or cancel an order, we will attempt to contact you by email, billing address, and/or phone number provided at the time of ordering.

Your purchases may only be returned or exchanged in accordance with our Refund/Return Policy [LINK].

You represent and warrant that your purchases are for personal use or household use and not for commercial resale or export.

Section 4 – Prices and Billing

Prices, discounts, and promotions may be changed without notice. The price charged for a product/service is the price in effect at the time the order is placed, as shown in your order confirmation. Unless otherwise stated, prices exclude taxes, shipping, handling, customs duties, and import fees.

Prices in the online store may differ from prices in physical stores or other online stores operated by third parties. Promotions may be subject to separate terms. In the event of a conflict, the promotional terms shall prevail.

You agree to provide current, complete, and accurate purchase, payment, and account information for all purchases, and to update information such as email address, card numbers, and expiration dates as needed so that we can complete transactions and contact you.

You represent and warrant that:
(i) the card information is correct;
(ii) you are authorized to use the card;
(iii) the card issuer will approve the transaction; and
(iv) you will pay all charges, including shipping, handling, and applicable taxes.

Section 5 – Shipping and Delivery

Delivery times are estimates and cannot be guaranteed. We are not responsible for delays caused by shipping carriers, customs clearance, or circumstances beyond our control.

Once we hand the products over to the shipping carrier, ownership and risk of loss pass to you.

Section 6 – Intellectual Property

The Services and their content, including trademarks, brands, text, images, graphics, reviews, video, audio, design, and more, belong to TEKZO, its affiliates, or licensors and are protected by applicable intellectual property laws.

You are granted only a limited, personal, non-exclusive, and non-transferable right to use the Services for private, non-commercial use. You may not reproduce, distribute, modify, create derivative works from, publicly display, store, or transmit material from the Services without our prior written consent.

TEKZO’s names, logos, product and service names, designs, and slogans are trademarks of TEKZO or its affiliates/licensors and may not be used without written permission. Shopify’s names, logos, and similar assets are trademarks of Shopify. Other names and logos on the Services belong to their respective owners.

Section 7 – Optional Tools

As part of the Services, you may gain access to customer tools from third parties that we do not control or monitor.

We provide such tools “as is” and “as available” without warranties or endorsement. We assume no liability in connection with your use of such tools. Use is at your own risk, and you should read and accept the third party’s terms.

Any new features and tools we make available in the future will also be subject to these Terms of Service.

Section 8 – Third-Party Links

The Services may contain materials and links to websites operated by third parties, including embedded functionality. We are not responsible for examining or evaluating the content or accuracy thereof.

If you leave the Services to visit third-party websites, you do so at your own risk. We are not responsible for any harm related to your access to, or purchase/use of, products, services, resources, or content on third-party websites. Please review these parties’ policies and terms before completing any transactions. Complaints and questions regarding third-party products and services should be directed to the third party.

Section 9 – Relationship With Shopify

TEKZO is powered by Shopify, which enables us to provide the Services to you. However, any purchase you make in our store is made directly with TEKZO.

By using the Services, you agree that Shopify is not responsible for any aspect of sales between you and TEKZO, including any harm or loss resulting from products or services purchased. You hereby release Shopify and its affiliates from any claims, damages, and liabilities that may arise in connection with your purchases and transactions with TEKZO.

Section 10 – Privacy Policy

Personal information we collect through the Services is subject to our Privacy Policy, and certain information may be subject to Shopify’s Privacy Policy, which can be viewed here. By using the Services, you confirm that you have read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your use of the Services in order to provide and improve the Services. Information you submit through the Services may be transferred to and shared with Shopify and third parties, possibly in other countries, in order to provide the Services. (ii) you have disclosed any compensation/incentive related to the Feedback; and

We may, but are not obligated to, monitor, edit, or remove Feedback that we determine is unlawful, offensive, threatening, defamatory, pornographic, obscene, or otherwise objectionable, or that violates intellectual property rights or these Terms.

You may not submit Feedback that infringes third-party rights, contains defamatory or unlawful content, or contains viruses/malware. You may not use a false email address or impersonate another person. You are solely responsible for the content and accuracy of your Feedback. We assume no responsibility for Feedback from you or any third party.

(a) upload viruses/malicious code;
(b) reproduce, copy, sell, or exploit the Services without permission;
(c) collect others’ personal information;
(d) engage in spam, phishing, pharming, pretexting, spidering, crawling, or scraping; or
(e) circumvent security features of the Services or related websites.

We may at any time suspend, disable, or terminate your account without notice if you violate these Terms.

Section 14 – Termination

We may at any time and at our sole discretion terminate this agreement or your access to the Services, in whole or in part, without notice. You remain responsible for all amounts due up to the date of termination.

The following sections will continue to apply after termination: Intellectual Property, Feedback, Termination, Disclaimer of Warranties, Limitation of Liability, Indemnification, Severability, Waiver, Entire Agreement, Assignment, Governing Law, Privacy Policy, and any other provisions that by their nature should survive termination.

Section 15 – Disclaimer of Warranties

Information on or through the Services is provided for general informational purposes. We do not guarantee its accuracy, completeness, or usefulness. Any reliance on such information is at your own risk, and we disclaim all liability for loss resulting from reliance placed on such content by you or others.

Unless expressly stated by TEKZO, the Services and all products are provided “as is” and “as available” without any express or implied warranties, including, but not limited to, warranties of merchantability, quality, fitness for a particular purpose, durability, title, and non-infringement.

We do not guarantee that use of the Services will be uninterrupted, timely, secure, or error-free. Some jurisdictions do not allow the complete disclaimer of implied warranties, so the above may be limited in whole or in part by applicable law.

Section 16 – Limitation of Liability

To the fullest extent permitted by law, TEKZO, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, licensors, as well as Shopify and its affiliates, shall not be liable for any direct or indirect loss or damage, including, but not limited to, lost profits, revenue, savings, data, replacement purchases, or other consequential damages arising in connection with the use of the Services or products purchased through the Services, or resulting from errors or omissions in content.

This applies regardless of whether the claim is based on contract, tort, including negligence, strict liability, or otherwise, even if we have been advised of the possibility of such damages.

Section 17 – Indemnification

You agree to indemnify, defend, and hold harmless TEKZO, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any claims, losses, damages, liabilities, or expenses, including reasonable attorneys’ fees, made by any third party as a result of:

(1) your breach of these Terms of Service or the documents they reference;
(2) your violation of applicable law or third-party rights; or
(3) your access to and use of the Services.

We will notify you of relevant claims, and our failure to provide prompt notice will not relieve you of your obligations unless your ability to defend the claim is materially impaired. We may, at our own expense, control the defense and settlement, but will not enter into any settlement imposing non-monetary obligations on you without your reasonable consent. You must cooperate in the defense, including by providing relevant information.

Section 18 – Severability

If any provision of these Terms of Service is deemed unlawful, invalid, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed without affecting the validity of the remaining provisions.

Section 19 – Waiver; Entire Agreement

If we fail to exercise or enforce any right or provision, this does not constitute a waiver of such right or provision.

These Terms of Service, together with policies and operating rules published on the website, constitute the entire agreement between you and us regarding the use of the Services and replace all prior agreements and communications, whether oral or written. Any ambiguities in interpretation shall not automatically be construed against the party that drafted the text.

You may not assign, transfer, or delegate this agreement or your rights/obligations without our written consent. Any attempt to do so without consent is invalid.

We may assign, transfer, or delegate these Terms and our rights/obligations without your consent or notice.

Section 21 – Governing Law

These Terms of Service and any separate agreements under which we provide Services to you are governed by and shall be interpreted in accordance with the laws of the jurisdiction in which TEKZO has its headquarters, with venue in the competent courts of the same place. You and TEKZO accept the jurisdiction of such courts.

The headings in this agreement are included for convenience only and do not affect the interpretation of the Terms.

You can review the latest version of the Terms of Service on this page at any time.

We may, at our sole discretion, update, change, or replace parts of the Terms of Service by publishing changes on the website. It is your responsibility to check for changes regularly. We will inform you of material changes in accordance with applicable law, and changes will take effect on the date specified in the notice.

Your continued use of the Services after changes are published means that you accept the updated Terms.
